A MAN who claimed he could not provide a breath test as he had recently been sprayed with CS gas by the police has been ordered to stand trial.

Jason Nash, aged 46, of Gurney Slade, appeared before Somerset Magistrates, sitting at Yeovil.

He pleaded not guilty to failing to provide a sample of breath for analysis at Yeovil on November 10.

A pre-trial review was conducted and the case was adjourned for a trial to take place on February 18 next year.

Until his next court appearance the defendant was given unconditional bail.
